1. Acceptance and eligibility

These Terms govern your use of oskaneze.com and services provided by OSKANEZE LLC (“OSKANEZE,” “we,” “us,” or “our”). By using the website or submitting a request, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally capable of entering contracts. A website inquiry alone does not obligate either party to proceed with a transaction.

2. Our role

OSKANEZE is an independent vehicle sourcing and coordination service. Depending on an agreed written mandate, we may search listings, review information, coordinate inspections, communicate with sellers, assist with negotiations and documentation, and coordinate transport or export providers.

Unless a signed agreement expressly states otherwise, OSKANEZE is not the seller, auction house, marketplace, manufacturer, insurer, lender, customs broker, freight carrier, repair workshop, vehicle-history database, or destination-country registration authority. We do not own third-party listings and are not affiliated with vehicle manufacturers or marketplaces referenced on the website.

3. Engagement, scope, and fees

Services begin only after we confirm the scope, timing, fee, expenses, and any required advance payment in writing. Each mandate may have a separate proposal, service agreement, invoice, or statement of work. If those documents conflict with these website Terms, the signed or expressly accepted engagement document controls for that mandate.

You authorize us to share relevant instructions and information with providers reasonably required for the agreed service. You remain responsible for reviewing and approving material decisions, including inspections, bids, offers, deposits, purchase terms, transport, insurance, and export instructions. Third-party fees, travel, inspections, storage, transport, taxes, duties, bank costs, and similar expenses are additional unless expressly included.

4. Listings, searches, and market information

Listings, photographs, prices, mileage, specifications, ownership claims, provenance, production figures, estimates, and availability may originate from third parties and can be incomplete, inaccurate, delayed, or changed without notice. Search results are provided for research and do not constitute an endorsement, appraisal, warranty, or representation that a vehicle is available, authentic, roadworthy, legally importable, or suitable for you.

Indicative value ranges and comparable-market observations are opinions for context, not certified appraisals, financial advice, or guarantees of purchase or resale value. Collector-vehicle markets are volatile. You should not transfer money or commit to a vehicle solely on the basis of website content.

5. Verification and inspection limitations

The scope of every review or inspection is limited to what is agreed, accessible, observable, and reasonably available at the relevant time. An online review cannot verify physical condition. A visual inspection is not a mechanical teardown. A pre-purchase inspection reduces uncertainty but cannot identify every latent, intermittent, concealed, future, or fraudulently obscured defect.

VIN, title, history, registry, originality, mileage, matching-number, restoration, and provenance reviews depend on records and specialist judgment. No review guarantees clean title, authenticity, absence of prior damage, future reliability, regulatory compliance, or acceptance by an insurer, customs authority, or registration body. Independent inspectors and workshops may be separate providers responsible for their own work.

6. Deposits, purchase, transport, and export

No bid, deposit, purchase, or shipment will be made on your behalf without the authority required by the applicable engagement. Vehicle purchases may be final and deposits may be non-refundable under seller or auction terms. You are responsible for ensuring funds are legitimate, timely, and sent only through confirmed instructions. Always verify payment instructions through a second communication channel before transfer.

Availability, inland transportation, storage, port schedules, ocean freight, insurance, customs value, duties, VAT, homologation, environmental rules, registration, and road-use eligibility vary by vehicle and jurisdiction. Timelines are estimates and may be affected by sellers, carriers, ports, authorities, weather, labor action, inspections, or other events outside our control. Destination-country customs, tax, technical compliance, and registration advice should be obtained from qualified local professionals.

Risk of loss, title transfer, insurance obligations, and responsibility for the vehicle are governed by the purchase documents, carrier terms, Incoterms if expressly adopted, and the applicable engagement—not merely by use of this website.

7. Client responsibilities

You agree to provide accurate instructions and information, disclose relevant deadlines and intended destination, review documents promptly, comply with applicable laws and sanctions, and refrain from using our services for fraud, money laundering, export-control evasion, title washing, tax evasion, or any unlawful purpose. We may decline or suspend work where identity, funds, ownership, legality, safety, or instructions cannot be reasonably verified.

8. Website and intellectual property

The OSKANEZE name, emblem, design, copy, dossiers, and original website materials are owned by or licensed to OSKANEZE. You may use the website for personal evaluation of our services, but may not scrape, reproduce, republish, misrepresent, interfere with, or commercially exploit it without written permission. Third-party trademarks, photographs, listings, and marketplace names remain the property of their respective owners.

9. Disclaimers

The website is provided on an “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties relating to the website and third-party information, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, OSKANEZE will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; lost profit, opportunity, use, or anticipated value; undiscovered vehicle defects; inaccurate third-party information; seller fraud; marketplace action; or delay or failure by an independent provider.

For claims arising only from website use, our aggregate liability will not exceed USD 100. For an accepted paid mandate, any additional limitation will be stated in the applicable engagement terms. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

11. Indemnity

To the extent permitted by law, you agree to indemnify OSKANEZE against third-party claims, costs, and losses arising from your unlawful use of the website, materially inaccurate instructions, violation of these Terms, or a transaction you direct in breach of law or third-party rights. This provision does not require indemnification for our own fraud, willful misconduct, or liability that cannot lawfully be excluded.

12. Suspension and termination

We may restrict website access or decline or terminate a mandate for nonpayment, unlawful or unsafe instructions, abuse, sanctions or fraud risk, material breach, or inability to obtain necessary cooperation. Accrued fees, approved third-party costs, confidentiality, intellectual-property rights, disclaimers, and provisions intended to survive will remain effective.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Subject to any mandatory consumer forum or law that applies to you, disputes arising from website use will be brought in the state or federal courts serving Natrona County, Wyoming, and the parties consent to their jurisdiction. Before filing a claim, please contact us and allow 30 days for a good-faith effort to resolve it.

14. General provisions

If any provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not assign an accepted mandate without our consent. We may use subcontractors and independent specialists consistent with the agreed scope. These Terms, the Privacy Policy, and any applicable engagement documents form the relevant agreement between the parties.
